Abstract

This paper examines the legal implications of cyber warfare under international law, focusing on the evolving nature of state conflict in the digital realm. As cyber warfare becomes increasingly prevalent, traditional legal frameworks must adapt to address unique challenges such as the attribution of cyber-attacks, state responsibility, and the implications for sovereignty. The study traces the historical development of cyber warfare, highlighting key events and the emergence of state-sponsored attacks. It analyzes core principles of international law applicable to cyber operations and discusses the complexities of attributing responsibility to states, especially when non-state actors are involved. Additionally, the paper reviews existing international treaties and agreements relevant to cyber warfare, identifying gaps that necessitate new legal instruments to enhance global cybersecurity. The findings underscore the need for an updated international legal framework that balances effective cybersecurity measures with the protection of civil liberties. Ultimately, this research aims to provide insights into how international law can better govern the challenges posed by cyber warfare, promoting cooperation among states while safeguarding human rights in the digital age.
